§ 35-1. Fireworks; definitions.

  • For the purposes of this division, the following words and phrases shall have the meanings respectively ascribed to them:

    Fireworks means any composition or device designed for the purpose of producing a visible or audible affect by combustion, deflagration or detonation and which meets the definition of common or special fireworks set forth by the United States Department of Transportation in Title 49, Code of Federal Regulations.

    Permissible fireworks includes only gold or silver sparklers, vesuvius fountains, spray fountains, torches, color fire cones, star and comet type color aerial shells without explosive charge for the purpose of making a noise, lady fingers not to exceed seven-eighths of an inch in length or one-eighth of an inch in diameter, total explosive composition not to exceed 50 milligrams in weight, color wheels and those fireworks authorized by the state fire marshal, by regulation, after having been submitted to him/her and tested to their safety and general use.

    Sale includes barter, exchange or gift or offer therefor, and each such transaction made by any person, whether as principal, proprietor, agent, servant or employee.
